It must also demonstrate that it complies with its obligations in the area of <a href=\"https:\/\/gespreobra.com\/en\/service\/occupational-risk-prevention-technicians-on-site\/\"><strong>Occupational Risk Prevention (PRL)<\/strong><\/a> and provide the relevant preventive documentation before and during its involvement on the site. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Preventive documentation<\/strong> makes it possible to demonstrate that the company, its workers, machinery and activities comply with the requirements demanded by Spanish regulations and, in addition, it facilitates coordination between all the companies working at the same workplace.<\/p>\n\n<p class=\"wp-block-paragraph\">For foreign companies that come to Spain to carry out a project, this process can be especially complex, as they must adapt their documentation and procedures to Spanish requirements.<\/p>\n\n<h2 class=\"wp-block-heading\">What preventive documentation must a contractor company submit?<\/h2>\n\n<p class=\"wp-block-paragraph\">The specific documents may vary depending on the characteristics of the project, the type of activity and the requirements established by the developer or the safety and health coordinator. However, there are certain documents that usually form part of a contractor company\u2019s preventive documentation. <\/p>\n\n<h3 class=\"wp-block-heading\">1. Safety and Health Plan<\/h3>\n\n<p class=\"wp-block-paragraph\">When the project has a design and falls within the scope of Royal Decree 1627\/1997, the contractor must draw up the <a href=\"https:\/\/gespreobra.com\/en\/service\/health-and-safety-coordination-on-construction-sites\/\"><strong>Safety and Health Plan (PSS)<\/strong><\/a> based on the Safety and Health Study or Basic Safety and Health Study.<\/p>\n\n<p class=\"wp-block-paragraph\">The PSS adapts the project\u2019s preventive provisions to the specific procedures the company will use to carry out the work.<\/p>\n\n<p class=\"wp-block-paragraph\">Before work begins, the plan must have the corresponding approval, depending on the type of project and the responsibilities established by the regulations.<\/p>\n\n<p class=\"wp-block-paragraph\">At this point it is important that the document is not a generic template. It must reflect the actual work procedures, the existing risks and the preventive measures that will be applied during execution. <\/p>\n\n<h3 class=\"wp-block-heading\">2. Evidence of the preventive organisation<\/h3>\n\n<p class=\"wp-block-paragraph\">The company must have an adequate preventive organisation and demonstrate that its human resources, both at management and production level, have the necessary preventive training.<\/p>\n\n<p class=\"wp-block-paragraph\">Law 32\/2006 establishes these requirements specifically for companies involved as contractors or subcontractors on construction sites. It also requires their registration in the <a href=\"https:\/\/gespreobra.com\/en\/service\/occupational-risk-prevention-consulting-and-document-management-for-companies\/\"><strong>Register of Accredited Companies (REA)<\/strong>.<\/a> <\/p>\n\n<p class=\"wp-block-paragraph\">For this reason, the REA should not be confused with a simple administrative document. It forms part of the requirements a company must meet to take part in certain subcontracting activities within the construction sector. <\/p>\n\n<h3 class=\"wp-block-heading\">3. Worker documentation<\/h3>\n\n<p class=\"wp-block-paragraph\">Preventive documentation must also make it possible to demonstrate that the people who access the site are properly authorised to carry out their duties.<\/p>\n\n<p class=\"wp-block-paragraph\">Depending on the activity and the site requirements, it may include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Occupational risk prevention training.<\/li>\n\n\n\n<li>Information on the risks of the position.<\/li>\n\n\n\n<li>Medical fitness for the position, where applicable.<\/li>\n\n\n\n<li>Provision of personal protective equipment (PPE).<\/li>\n\n\n\n<li>Authorisations to use certain equipment or machinery.<\/li>\n\n\n\n<li>Professional accreditations or specific training.<\/li>\n\n\n\n<li>Appointment of preventive resources, where required.<\/li>\n\n\n\n<li>Documentation relating to posted workers, in the case of foreign companies.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The documentation must be kept up to date and available for review by those responsible for preventive coordination.<\/p>\n\n<h2 class=\"wp-block-heading\">What must subcontractor companies submit?<\/h2>\n\n<p class=\"wp-block-paragraph\">Subcontractors must provide documentation that allows the contractor company and the other site agents to verify that they comply with their preventive obligations.<\/p>\n\n<p class=\"wp-block-paragraph\">Preventive documentation that may be requested includes:<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Company documentation<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Company identification and details.<\/li>\n\n\n\n<li>Registration in the REA, where required.<\/li>\n\n\n\n<li>Preventive organisation.<\/li>\n\n\n\n<li>Certificates or accreditations of preventive training.<\/li>\n\n\n\n<li>Documentation related to Social Security and labour obligations, where required by the coordination procedure.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Worker documentation<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>List of workers who will access the site.<\/li>\n\n\n\n<li>PRL training.<\/li>\n\n\n\n<li>Preventive information.<\/li>\n\n\n\n<li>Medical fitness, where applicable.<\/li>\n\n\n\n<li>Provision of PPE.<\/li>\n\n\n\n<li>Specific authorisations and accreditations.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Work and equipment documentation<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Work procedures.<\/li>\n\n\n\n<li>Specific risk assessments.<\/li>\n\n\n\n<li>Machinery and equipment documentation.<\/li>\n\n\n\n<li>Equipment checks and inspections.<\/li>\n\n\n\n<li>Certificates and manuals as required.<\/li>\n\n\n\n<li>Auxiliary means documentation.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Requirements may vary from one project to another. Therefore, in addition to complying with legislation, it is necessary to review the documentary requirements established by the developer, the contractor and the safety and health coordinator. <\/p>\n\n<h2 class=\"wp-block-heading\">Subcontracting Book: a specific obligation for construction sites<\/h2>\n\n<p class=\"wp-block-paragraph\">Preventive documentation is not limited to the files of each company and worker. Spanish regulations also establish specific obligations to control the subcontracting chain. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Law 32\/2006<\/strong> establishes that each contractor must have a <strong>Subcontracting Book<\/strong> on each site included within its scope of application. It must record the subcontracting carried out, the level of subcontracting, the commissioning company, the subject of the contract, certain responsible persons and the information relating to the delivery of the corresponding part of the Safety and Health Plan, among other data. <\/p>\n\n<p class=\"wp-block-paragraph\">Royal Decree 1109\/2007 sets out the conditions for this book and establishes that it must be authorised before carrying out the corresponding subcontracting.
